3.2.14 Intellectual property rights

The institution’s policies are clear concerning ownership of materials, compensation, copyright issues, and the use of revenue derived from the creation and production of all intellectual property.  These policies apply to students, faculty, and staff.

Non-Compliance

The institution system’s bylaws and regulations contain a clear policy regarding intellectual property, including ownership, compensation, copyright, and revenue distribution in part II, chapter VII.  These policies are further updated with various campus and system policy memoranda and policy statements.  There are inconsistencies between the system regulations found in chapter VII and some older memoranda and policy statements that are resolved with the institution’s legal and administrative offices.  One of the most relevant LSU Policy Statements was last revised in 2003.  Inconsistencies with system regulations and institutional policy statements should be corrected.


LSU A&M’s Response

The SACSCOC Off-site Committee agreed that Louisiana State University and A&M College (LSU) has a clear intellectual property policy. The Off-site Committee states:

The institution system’s bylaws and regulations contain a clear policy regarding intellectual property, including ownership, compensation, copyright, and revenue distribution in part II, chapter VII.  These policies are further updated with various campus and system policy memoranda and policy statements. 

However, because the Off-site Committee reports “inconsistencies between the system regulations found in chapter VII and some older memoranda and policy statements”, the following actions have been completed:

In the January 31, 2014 meeting of the LSU Board of Supervisor a proposal was submitted by the senior staff of the LSU Board of Supervisors for the Board to:

  1. Revise the Board's Regulations, Chapter VII, to incorporate non-duplicative information from LSU System Permanent Memorandum 16 (Technology Transfer) and LSU System Permanent Memorandum 64 (Intellectual Property - Distribution of Royalties and Other Matters); and
  1. Repeal Permanent Memorandum 16; and
  1. Repeal Permanent Memorandum 64 [1].

These items were passed by the Board on January 31, 2014and the actions of the Board have been certified [2].

The revision of Chapter VII of the Board Regulations and the elimination of PM 16 and PM 64, ensures that the policies on Intellectual Property is now consistent with the existing LSU Policy Statement 68 on University Intellectual Property Rights in Sponsored Research Projects [3].
