(4) Data Practice Laws

Standard 27. The unit must:
(4) comply with state and federal data practices laws; 

The UED complies with the federal law Family Educational Rights and Privacy Act (FERPA), as well as Minnesota statutes Chapter 13 Government Data Practices and Minnesota Rules Chapter 1205 Data Practices to protect the privacy of student education records and personal information collected by the University or UED. Except as otherwise provided in law or University Policy, data on students is private and may not be shared with other party. As such, we protect personal information by “not” identifying personal  information of any teacher candidates in order to avoid breaches during the data collection process and reporting process (e.g., names, date of birth, addresses, phones or individual demographic information) when submitting accountability reports or sharing data reports with stakeholders. Data shared with stakeholders about candidate performance is aggregated to protect student privacy. 

Furthermore, student data are secured. There is only authorized access to individual student data in the University database (ISRS), and there is a 2-way authentication process used for access to any non-public data sets. Only the Director of Field Experiences, the Assessment and Reporting Coordinator and the Dean have administrative access to information in TaskStream. Prior to 2022, students’ physical files were kept in secured area and in 2022 these files for current students were scanned and converted to e-files in a secured application called Perceptive Content that requires authorized access for staff and faculty. Upon hire, all new faculty and staff are required to complete a FERPA/state, federal data practice laws training sessions. Periodically, the University Registrar/Student Data Practices Compliance Official will send emails to the whole university with updated information and guidance about following FERPA.
